Right of Petition before Parliament: Contributing to a Characterization of its Exercise

This article examines the way in which the exercise of the right of petition before Parliament has been characterized and the treatment this instrument of citizen participation has received from this body. The conclusions we reach point to denying some of the "ideas made" about this issue. Thus, despite the extreme informality with which it can be used and the breadth of interests that can be pursued (particularly personal), we find that the petitioners have favored this instrument for the defense of the public interest. Or even though the number of petitions submitted by legal entities is significant, this instrument is still mostly an instrument of citizen participation. Regarding the handling of petitions by Parliament, we have confirmed the length of its consideration, but significant improvements have been noted over the last few years.

Este artigo analisa a forma como se tem caracterizado o exercício do direito de petição perante o Parlamento e o tratamento que este instrumento de participação dos cidadãos tem merecido por parte deste órgão. As conclusões a que chegamos apontam no sentido de desmentir algumas das "ideias-feitas" sobre este instituto. Assim, apesar da extrema informalidade com que pode ser usado e da amplitude de interesses que podem ser prosseguidos (nomeadamente pessoais), verificamos que os peticionários têm privilegiado este instrumento para a defesa do interesse público. Ou ainda que, embora o número de petições apresentadas por entidades colectivas seja significativo, este instrumento ainda é maioritariamente um instrumento de participação dos cidadãos. Relativamente ao tratamento das petições pelo Parlamento, confirmámos a morosidade na sua apreciação, registando-se, no entanto, melhorias significativas ao longo dos últimos anos.
